Website Terms of Service

Terms governing access to the Lurny website and use of its materials.

1. About these terms

These Website Terms of Service govern access to and use of the public websites operated by Lurny Innovative Labs Pvt. Ltd. (Lurny, we, us or our) that display or link to these terms. They cover website content, downloadable resources, enquiry forms and public interactive demonstrations made available through those websites.

Please read these terms before using the website. Where we ask you to accept them for a particular feature, your acceptance applies to that feature and related website use. If you do not agree, do not use that feature. Your use of other parts of the website is subject to these terms to the extent they are validly incorporated under applicable law.

2. Enterprise services and separate agreements

Paid subscriptions, customer workspaces, mobile applications, implementation services, integrations and enterprise trials are governed by the applicable service agreement, order form, trial agreement and data processing terms. These website terms do not amend those agreements or change their pricing, service levels, confidentiality, data ownership, liability or termination provisions.

Where a separate agreement applies to a service, it prevails over these terms for that service. Additional terms for a particular website feature apply only when clearly presented and accepted as required. A website description, demo request or conversation with a website assistant does not by itself create a paid subscription or an enterprise service commitment.

3. Eligibility and authority

You must be at least 18 years old and legally competent to enter into a contract to create a website account or accept terms for an interactive feature. If acting for an organisation, you must have authority to act for it. Access by younger learners to an institution’s contracted services is governed by the applicable institutional arrangements, not these public website terms.

Provide accurate information when submitting an enquiry or registering for a feature. Do not impersonate another person or misrepresent your relationship with an organisation. If a website account is provided, keep its credentials secure, do not share them without authorisation and promptly report suspected misuse. You are responsible for activity you authorise and for your own failure to take reasonable care of your credentials.

4. Permitted website use

You may browse the website and use resources made available for download for your own evaluation, learning or internal business reference, subject to any licence displayed with the resource. Keep copyright and ownership notices intact. This permission does not grant access to restricted systems or a licence to resell, redistribute or commercially exploit Lurny’s materials.

You may link to a publicly accessible page in a fair and lawful manner that does not imply endorsement or affiliation. Do not frame the website or use Lurny branding in a way that could mislead users. We may ask you to remove a link that infringes rights or materially misrepresents our relationship.

5. Unacceptable use

You must not use the website to break the law, infringe intellectual property or privacy rights, deceive others, harass anyone or submit unlawful material. Do not upload malicious code, send unsolicited bulk communications or interfere with other users’ access.

Do not bypass authentication or usage restrictions, access another person’s information, overload the website, or perform vulnerability scanning, penetration testing or other intrusive security testing without our prior written authorisation. If you discover a suspected vulnerability, report it through the contact details below without accessing additional data or disrupting services.

Do not scrape or systematically extract website content, harvest contact details, or use our content to build a competing dataset or train an AI model without permission, except where applicable law expressly permits it. Ordinary search-engine indexing consistent with our published crawler instructions is permitted.

6. Ownership of website materials

Lurny and its licensors retain rights in the website, software, designs, text, graphics, videos, logos and other materials, except content owned by users or third parties. Product and company names belonging to others remain their respective owners’ property. No trademark licence or transfer of ownership is granted by website access.

Except as permitted in section 4, an applicable licence or mandatory law, you may not reproduce, modify, distribute, sell or create derivative works from protected website materials without the rights holder’s permission.

7. Information and material you submit

You retain any rights you hold in material you submit. You grant Lurny a limited, non-exclusive permission to receive, store, reproduce and process that material only as needed to respond to your request, operate the feature you choose and meet applicable legal duties. Service providers may assist us for those purposes under appropriate restrictions. This permission does not authorise selling your material, publishing it as a testimonial or using it to train general-purpose AI models.

Submit only material you are entitled to provide and that is appropriate for the feature. Public enquiry forms and demos should not be used for passwords, payment credentials, confidential customer records or sensitive personal information. Arrange an appropriate secure channel and agreement before sharing such information. Personal information is handled as described in our Privacy Policy; these terms do not replace any required consent or other lawful basis.

If you voluntarily provide suggestions about our website or products, we may use those suggestions without payment or attribution. This does not transfer ownership of your underlying materials or permit us to disclose your confidential information or personal information.

8. Demonstrations and AI generated responses

Public demonstrations, sample reports and illustrative dashboards are provided for evaluation. They may use example data, simplified workflows or features that depend on configuration, subscription or deployment. A demonstration is not a promise that every illustrated feature is included in a particular purchase.

Where a website assistant or demo uses AI, its responses may be inaccurate, incomplete or outdated. Check important information with an authorised Lurny representative. Do not rely on such responses as legal, financial, medical, security or other professional advice, or as the sole basis for a decision affecting a person’s rights or livelihood.

An AI-generated response cannot bind Lurny to a quotation, warranty, contract amendment or service commitment. Ownership and permitted use of outputs from contracted products are governed by the applicable product agreement. Nothing in these website terms guarantees that an AI output is unique or free of third-party rights.

9. Product information and commercial enquiries

We aim to keep website information accurate, but descriptions, availability and indicative pricing may change. Roadmap items and planned release dates describe intentions and are not delivery commitments unless expressly included in a binding agreement. Case studies and examples do not guarantee comparable results for every customer.

Submitting a form or requesting a demonstration does not place an order. Fees, taxes, payment schedules, renewal, cancellation and refund rights for a purchase must be stated in the applicable quotation, order or checkout terms. These website terms alone do not authorise charging you or enrolling you in an automatically renewing service.

10. Privacy and third party services

Our Privacy Policy explains the collection and use of personal information through the website. Cookie notices and preference controls, where applicable, explain tracking technologies. Accepting these terms does not constitute consent to optional marketing, recording or non-essential cookies.

The website may link to third-party sites or include third-party tools, media or integrations. Unless expressly stated, a link does not indicate endorsement. Their independent services are subject to their own terms and privacy notices. We remain responsible for our own obligations, including those relating to providers processing information on our behalf.

11. Availability and changes to the website

We may update, replace or discontinue public website content and features, and may interrupt access for maintenance, security or operational reasons. We do not guarantee uninterrupted or error-free public website access. Contracted availability, support and continuity obligations remain governed by the relevant service agreement.

To the extent permitted by law, public website content and free demonstrations are provided on an “as available” basis without a guarantee that they are complete, current or suitable for a particular purpose. This does not limit any express commitment in a binding agreement or any right that cannot lawfully be excluded.

12. Responsibility and limits of liability

To the extent permitted by applicable law, Lurny is not liable under these website terms for indirect or consequential losses arising from public website use, including consequential loss of profits, business opportunities or anticipated savings. You should keep your own copies of material you need and verify information before relying on it.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer and data protection rights remain unaffected. Liability under a separate customer agreement is governed by that agreement, not this section.

13. Restricting access

We may restrict or suspend public website or demo access where reasonably necessary to address a material breach of these terms, a security risk, unlawful activity or a legal requirement. Where practicable and appropriate, we will explain the reason and allow an opportunity to resolve it. Immediate action may be necessary to protect users or systems.

You may stop using the website at any time. Restrictions under this section do not automatically terminate a separate customer subscription. Ownership provisions, accrued rights and provisions that reasonably need to continue, including liability and dispute provisions, survive the end of website use.

14. Updates to these terms

We may revise these terms and will show the effective date of the revised version. Material changes will be brought to users’ attention through an appropriate website notice or direct communication where relevant. We will obtain renewed acceptance where required. Changes apply prospectively and do not retrospectively alter accrued rights or separately agreed customer contracts.

15. Governing law and disputes

These website terms are governed by the laws of India. Subject to mandatory rights and jurisdiction rules, the competent courts in Bengaluru, Karnataka, have exclusive jurisdiction over disputes arising from these terms. This does not prevent a consumer from using a court, tribunal or statutory complaint process available under mandatory applicable law.

Please contact us first so we can try to resolve a concern. Doing so is not a condition that prevents either party from seeking urgent relief or exercising a statutory right. If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. Failure to enforce a provision on one occasion is not a waiver of future enforcement.
